House Bill 06-1364 – Concerning offenses related to the location of a protected person

Prior to the granting of any Guardianship or Conservatorship, State law now requires
the filing of a completed Acceptance of Office (in place of Acceptance of Appointment) including a name-based criminal history check and a current credit report for each nominee. [click here to read more]

Court Visitor Fee Increase to Take Effect September 1, 2008
The fee for all court visits (currently $75/visit) is increasing to $100/visit effective September 1, 2008.  It will still be a flat rate fee with no additional costs.

Conservatorship - A conservator is one who is appointed by the court to manage the estate of a protected person. A Conservatorship may be opened for a minor or for an adult person who is unable to manage their property and affairs for reasons such as mental illness, mental deficiency, physical illness or disability, chronic use of drugs, chronic intoxication, confinement (15-14-401 C.R.S.)

The court may appoint an individual, a trust company, or a bank with general power to serve as trustee, as conservator of the estate of the protected person. An individual appointed must be 21 years of age
or older.

Venue for protective proceedings is in the place in this state where
the protected person resides, or, if the protected person does not reside in this state, in any place where property is owned.

Guardianship (Adult) - A guardian is a person lawfully vested with the power and charged with the duty of taking care of the person. An incapacitated person is defined as any person who is impaired by reason of mental illness, mental deficiency, physical illness or disability, chronic use of drugs, chronic intoxication, or other cause to the extent that he/she lacks sufficient understanding or capacity to make or communicate responsible decisions concerning his/her person (15-14-101(1) C.R.S.).

Guardianship (Minor) - A guardian is a person lawfully vested with the power and charged with the duty of taking care of that person. A minor is defined as a person under the age of 18 who is unmarried.

House Bill 06-1364 – Concerning offenses related to the location of a protected person Effective Date July 1, 2006, offenses committed on or after said date

Summary of the Act:
This bill creates a new class 1 misdemeanor of assisting a restrained person in discovering the location of a protected person; creates exceptions when the protected person is sought for a lawful person or restrained person is a defendant in a criminal case, party to a civil case, action for dissolution of marriage, or other legal proceeding and the lawful purpose is to interview the protected person or issue a subpoena or summons and creates affirmative defenses.
