Q. How do
I know what form to use?
A. Is there a will? Are you named in the will? If you answered yes to
these questions, download Testate Informal
A. If there is not a will - Are you applying to be the personal representative?
Are there any objections? If you answered yes to applying to
be the personal representative and no to any objections, download
Intestate Informal.
If there are objections, download Intestate Formal.
Q. What
is notice?
A.
Notice is a way to tell people that a hearing is going to be held or that
the Court is going to order something to happen.
Q. Do I have
to “give notice”?
A.
The law requires you to give notice to interested parties. If you do not
show the Court proof of notice before the hearing, your hearing will be

Q. What
is an Ancillary Proceeding?
A. An ancillary proceeding is one in which a personal representative
appointed in another state (a foreign personal representative) wishes
his/her letters recorded in Colorado so that business may be more readily
conducted here. For example, a person appointed as personal representative
in Kansas, may need to sell Colorado property belonging to the decedent’s
estate.
